My Lawyer Called Me That File Is Ready To Go But Vsc, Tsc And Csc Are Not Excepting Any I-140 Now, They Has To Be File At Nsc. If you are eligible for EB1, file I-140 now. EB1 is always current in every VB. No need to port EB3 PD. For EB1, no need for Labor process; direct I-140 filing.

I am currently working on EAD, having invoked AC21 once in the past. My labor was filed in 2005 under EB3 (I was eligible for EB2, but my company filed it under EB3, as per their policy). I filed 485 during July 2007 fiasco and am currently working on EAD.
My job qualifies for EB1 now and few of my peers have got Green Card under EB1. Can I port my filing from EB3 to EB1? Would it be better to do it with current employer or with a new employer? Pl. advice.

Hi all,
I submitted an application via premium processing for EB-1a with USCIS at the Texas Premium Processing Centre last month (April 2007).
I received an RFE notification via letter after two weeks listing the requirement of further evidence against 3 out of the 8 criteria I submitted.
I can submit further evidence - but my question is this ... "Why have they not made mention of the other 5 criteria I submitted" ? Has this failed ? Do they not matter ?. I am quite concerned because they have not made any mention of my other criteria ? Does anyone have any advice.

Hi,
I went to infopass inquiry today. Immigration agent told me on counter that my I485 is in final review stage and you don�t have to worry about I140. You can receive your GC very soon.
I filed I485 based on pending I140 with PD Jun 2004 and this is still pending. My other I180 that is approved has PD March 2008. Agent also told me that I should forget about I140 and PD. I485 cannot in Final stage if I140 is not clear. He told you should not worry about PD also because I485 cannot be in final review stage if there is PD issue.
My I485 is in EB2 category and currently USCIS is processing the cases with PD 2005 or less.
Can some please explain me that what does the Final Review stage means? Is that mean I will get GC pretty soon even my I140 and PD combination is not approved/ current.

The reflection in the wet sand is good & colors are nice, but I agree with Don that there is too much sky for the scale of the figure. I had to look for the silhouette, because the clouds drew my eye to the left of center. A little saturation work would probably make the colors even more appealing. I am on AOS 485 pending, EB3-I.
But entered on H1.
ZERO questions asked or any issues encountered at IAD.
There was only 1 officer assigned to take care of non-US citizens.

Dear Sir/Mam,
I am presently working in India. My wife is getting an L1 visa approval petition. We need to go to the US consulate for visa stamping.
My question is that 1) Do I need to resign from my current job to get a L2 visa stamping on my passport? 2) If not required, do I need to carry any form or letter from the company that I am on long leave/vacation to show it to the US consulate officier?
Please advice.

You don't need to quit your job nor show any documents on extended leave to get a visa. Since your wife is the primary applicant, you just need to show proof that you both are still under bonafide marriage. Obviously, you will have to quit or take extended leave when you intend to travel to US but nothing to get a visa.

Hi guys,
My LCA got denied today (reason unknown) and my H1-B has expired on Nov. 1 as well. :(
I also have a pending I-485 petition with approved I-140. I also have a valid EAD. So I assume, I am currently shifted to AOS pending status working on EAD.
My question is whether this denial negatively affects my pending I-485 application? I assume not but just wanted to confirm anyways :confused:

My passport will be expiring in next 6 months. I do have an appt pending with US embassy Bombay. I have some queries, if someone can please guide me:
1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?
Pls suggest.

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)

The Z in Zelda seems a bit too hard to read. Have you considered using a more top-down view of Zelda from a game like Link to the Past? That might work better.
