The only difference for you is you dont count under the cap for H1B quota. Everything else is same.

I am interested as well. We can control our own destiny. What kind of issues can one get in RFE's for 485 that we wont be able to answer and the lawyer will? We need a copy of the Labor and 140. Don't we? We can file for AP & EAD now along with 485 or use the receipt number to file for AP & EAD later.

Hi,
to stay away from india while on AOS, you need AP.

to maintain AOS, one needs to keep renewing AP.

So when you apply/renew AP candidate needs to be here...

So your daughter will apply for AP, get it , travel... come back 6 months prior to AP expiry, go to india and study and you will send AP by mail ...
she will come here every 4-6 months prior to AP expiry and renew and go back.

You need to give a sound reason in port of entry why you are staying away for long durations..!

Obstacles to innovation in my community: I belong to the community of people who are in US on a work visa. Our main obstacle is the US laws themselves, because the present laws forbid us from doing anything on our own. If I wanted to make facebook, US laws would say, hey, go back home and come back on an EB5. Of course, we cant do that. So your laws are being ridiculous

Hey wp7t3,
How familiar are you with creating apps in Blend? If you are not very familiar, I would strongly suggest looking through the tutorials found in the Basics / Overview section: http://www.kirupa.com/windowsphone/index.htm

They should provide you with a basic understanding of how to add controls to your project, make some tweaks to them, etc.

AFter FP, the LUD is because, during FP, they pull up the records or update the record with your Photo and signatures etc.

Name check is initiated after Notice is generated on ND. So it is seperate from FP.

FP response, not sure what happens when it comes back.

Why do you think anyone in India including the government will spend there political good will to help people like us? Since we are planning to leave India for good and possibly become USC in due course of time there is nothing to gain from helping people like us. . They might ask for H1/L1 etc because it impacts Indian companies.

India looses talent when we immigrate, it is unfair to ask them to help expedite this

I have returned from India on AP three days ago. Immigration officer just asked questions on my employment, but he did not ask for proof. If you have multiple APs you should submit all of them for stamping. Thats it!

I got AP..and H1B till 09..I am hoping to reenter using AP while comming back from india..Apart from AP do I require anything else. like employement letter to reenter the contry??..

Mods, please remove my post (and maybe it would make sense to create threads specific to the USCIS/DOS mess up to - at the moment it does not look very organized to me and it is hard to find information. Maybe sub-threads with "law suit", "publicity" would channel comments better?)

I only read about an article in two online newspapers but believe this whole topic should get significantly more attention. I do not know if that is going to help to get this started but I sent an e-mail to our local TV stations and hope that some may be interested and even pick it up. Again, no idea if this is going to work but I assume that if they get more e-mails regarding the same topic, interest will come up....

With having many international operating companies in the U.S. who all employ legal alliens who are going through the "greencard process" to become legal permanent residents, the Department of State (DOS) and the U.S. Citizenship and Immigration Services (USCIS) have destroyed many plans, caused significant financial loss for applicants and very likely acted against the law. I think this would be well worth a few minuted report - everybody is talking about the pain that the illegal immigrants go through but (without taking away anything from that), the pain of legal alliens having to deal with the willful behavior of USCIS and DOS is not much better.

Yes you have to fill out separate forms. I applied for my parents last october. One of them got it in 10 days and the other took more than a month. It is advisable to get the application in well ahead of your trip
