Guys:
Our( my wife of H4 and me on H1) currently have visas stamped till end of Feb'07.
Now, I am going to file for my extension.
The question is that if my wife travels out of US before end of Feb, according to my lawyer we do not need to file foe her extension.
When she is to come back the lawyer says that she would get her H4 visa based on either my pending application or approved extension.
Is this possible, that without filing for her extension she can get her H4 in Delhi stamped, based on my extension application..??
Please share your thoughts.. I am perplexed..!!!
Thanks

I been working on H1-B for sometime. My project ended 3 months ago and I had been unpaid since then. My H1-B expired on Sep 30, 2009. My company applied for H1-B extension in June but got a RFE due to lack of evidence. Cmpany replied to the RFE. The status has been pending since then. On Sep 19, I got an offer from another company. The new company filed for premium processing for H1-B transfer and the transfer application got approved with starting date of September 24. I haven't got my new approved I-797 yet.
I joined the new company on Sep 29 but haven't notified her old employer yet and hence they didn't withdraw my application. My immigration is underway and I have got an approved I-140 from my previous employer. That is the reason I didn't notify them as I don't want to stop that process. It is my intention to move back to my old employer if my visa extension is approved so that I don't have to refile for Green card.
Now the question is what will happen in these scenario and purportedly 'Last Action rule' of USCIS:
1) If my Visa extension gets accepted, which VISA will hold good, the H1 ext with original employer or H1-B transferred visa with new employer as the H1-ext will be the last decision by USCIS ? Where should I report for work. Can I chose among these two employers who I want to work for?
2) If my visa extension gets rejected, will my transferred VISA still hold good ? Will I need to do anything in that scenario i.e. need to go out of country and get my visa stamped ?
What is my best course of action.
Any help will be really appreciated.

Can you get a SSA benefit if you don't have a GC? Isn't that a Catch 22?
Well I dont get SSI benefits but is there a way we can convince USCIS to expedite cases that meet the first condition?

Hello all,
For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ??

Gurus,
My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.
Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?
I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!
Please help.
Thanks!

Hi,
My parents got their second Re-entry Permit approved (applied through Application I-131) in first week of Jan 2008. This rentry permit is valid for 2 years (i.e. till Jan 2010). They had applied for the second Re-entry Permit on 16th Feb 2007. And after applying it they left 19th Feb 2007.
They are planning to return to US in Jan 2010 before the Re-entry Permit expiration. I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.
In my parent's case, when they will return back to US in Jan 2010, they will already have spend 3 years outside US.
I was concerned that the 2 year stay limit will be counted from the day my parents left US or the day when the Re-entry Permit got approved?
Secondly, Is there any limit on number of times a Re-Entry Permit can be applied?

There should not be any issues changing the employer after 180 days. This would include proper way of resigning the company so that they don't do anything which will affect your green card.
There are lot of response on this and you should check those.

I congratulate everybody for getting the opportunity to file 485.I am truely happy for u guys.
I am one of the very few people who can not apply for 485 as I have just changed my company and labour yet has to be filed.
I just wanted to to know Is it still possible that they will bring some kind of amendment(From CIR bill) which wouldn't allow me to extend my H1 Visa after 6 years?.I am so scared when I read on numberusa that some amendments are coming back to vote. Are we really in trouble?.
I just need some lodgical reasons that it won't happen.
I know everybody is busy but don't forget about people like us.
No such proposal will be coming for another next two years for minimum. In the meantime, file your labor and and while you wait for approval, prepare your exp letters so that u r ready to file on day one after your labor is approved. bol

Can anybody please let me know what are the documents needed to file for 485. If I do not have any immunization record, how can I show that immunization record?
Somebody with experience please post. It has been answered earlier elsewhere, but I could not find it through search.
Thank you

Hello - I have a unique situation. I'm currently in the US on H1B, and my fiance is in India working for a reputed software company. We are planning to get married by end of April.
I want her to come to US on a work visa (hopefully H1B). I got to know that to make the FY09 H1B cap, she has to apply for H1B on Apr 1 2008, and wait till Oct 1 to travel if her visa gets approved. But since we are getting married by end of April, I don't want her to stay in India till October while I'm here.
The other option I was thinking was to apply for her H1B on Apr 1, but still go ahead and apply for H4 in early May, so that she can travel on H4 in May. And once her H1 is approved, she would already be in the US and can start working from Oct 1. Is this possible? Will this plan create any problems for her H4 or H1 visa application?
If the above does not work, what are my other options? If I miss the Apr 1 2008 deadline, the next earliest she can apply for H1 is Apr 1 2009, and work from Oct 1 2009 - and I don't want to wait that long.
Another option is to get married before Apr, get her to US on H4 before Apr, and apply for change of status to H1 on Apr 2008. But the marriage plans for Apr is made and to push the dates back would not be easy.
Any help in this matter is appreciated.
Thanks in advance,

Hi all,
I understand there have been several threads in the past discussing the use of EAD for part time work while using H1 for the full time job. There were different views expressed by the group at that time.
Has there been a consensus on this issue?
Thanks

The reason that your code is not working is that e.Key only references the most recently pressed key, so it can't be equal to 3 different keys at once.
If nothing else, couldn't you maintain a list/array of the currently pressed keys? You could update the list with handlers for KeyUps and KeyDowns and figure out whether a certain combination of keys was pressed by iterating through the array. I'm not sure if there is built-in functionality to do this, but it would be easy enough to implement.

This is not from Bill Gates. It's an excerpt from the book "Dumbing Down our Kids" by educator Charles Sykes. It is a list of eleven things you did not learn in school and directed at high school and college grads.
