I-485 need to file when your PD need to be current.
Indian Bro/sister need to wait 10 years to file I-485.
So you can file I-485 in 2020 AD.

Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.
In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

I have permanant opprtunity with one organization which wants me to work on EAD. My situation is like this
my EAD is expiring on XX/XX/2010. The new compnay wants me to join on YY/YY/2010. My questions are
1. IF 15 after joining new Compnay, I apply for EAD renewal and before filing for AC21,Will it create a problem. Since I can only file EAD renewal 4 month before expiration date I need to do it some where in april.
2. In case my Old employer revoke 140 before I file EAD renewl and AC21 will it create a problem?

Monthly ~250 allocation is not good enough to cover pending cases prior to May 2006. prior to May'2006 no.of pending cases are close to 2700 cases, so this year quota is good enough to clear these pending cases. With porting we may also see Unavailable down the time.
This leaves for 2006 pending cases
China - 2950
India - 11800 . total ~15K
If we get spill over of 14K then EB2 India & China will move to 2007. Do we get 14K spillover for current year is Big ?

Total 22,077 so 90K-22K = 68K available for 2011 for categories. EB1, EB5 & ROW EB2

Thanks for the reply.But in my H1-B petition the DOB is correctly enetered.In my H1 stamping(Visa) the DOB is not correctly enetered.When i went to Driving licence office they checked my passport DOB and Stamped VISa DOB.and they asked me to get the DOB corrected in the Visa.one of my friend suggested me to goto INFOPASS and get it corrected.
Do u have any idea?

I have applied concurrently for green card under EB2 in August 2007.Received I140 approval and I485 is in process. Have applied for H1b extension and is pending. I am working for a consulting firm at present. I got job offer for a permanent position with the client that has same job duties and title. But the salary is about $20, 000 lower than what my consulting firm is paying now. My labor was applied with a higher salary. Can this lower salary and the difference create problems with the green card processing? Did anyone have any of this experience? Please help!!!
Yes, lower salary by that much will be a basis of denial of your I-485. Your new position must have at least the salary mentioned in the LC.

We had the same situation with my wife's H1-B. We spoke to the lawyer and he had forwarded us an e-mail reply from USCIS, stating that USCIS had decided to issue the validity of 797 from the date of adjudication or approved date rather than from the previous expired h1B date and this is not happening across all the cases. I also have applied at the same time as my wife's h1 and My h1b dates are matching.

I looked almost everywhere I could but was wnable to find "bottom tabs" like the ones BCIS prefers. Does anyone know where to get them from? It is a nightmare trying to file all these documents in an index.
